自宅僅一戶 出售免奢侈稅 - 鉅亨網 Mar 28th 2012, 23:45 【經濟日報／稅務問答】 嘉義縣中埔鄉余先生問：個人出售持有期間未滿兩年的自住房屋，須再申報特銷稅嗎？ 南區國稅局嘉義縣分局答覆：銷售持有期間在兩年以內房屋及其坐落基地或依法得核發建造執照之都市土地，應依規定申報繳納特種貨物及勞務稅（即俗稱奢侈稅）；但所有權人與其配偶及未成年直系親屬僅有一戶房屋及其坐落基地，辦竣戶籍登記且持有期間無供營業使用或出租，其銷售房地免徵特種貨物及勞務稅。「僅有一戶房屋及其坐落基地」之認定，不包括非可供居住停車位，如停車位原係與自住房地並同使用，且該房地符合前述免徵規定者，該停車位與自住房地並同銷售，可免徵特種貨物及勞務稅。該分局說明，出售符合前述免徵特種貨物及勞務稅的自住房地，如一起出售有獨立權狀合併使用的共用設施土地，該共用設施土地亦免徵特種貨物及勞務稅。 This entry passed through the Full-Text RSS service — if this is your content and you're reading it on someone else's site, please read the FAQ at fivefilters.org/content-only/faq.php#publishers.
